Chapter 7 : Record keeping

29. Information to be recorded

(1)An authorised  officer—
(a)who is employed by an issuing authority, who has issued or served an infringement notice form AARTO 01 or recorded the particulars of an infringer or offender on form AARTO 32 in terms of the Act, must submit the copy of such an infringement notice or the document on which the particulars of an offence have been recorded, together with such authorised officer's confirmation of service to the issuing authority; or
(b)who is a member of the service as defined in section 1 of the South African Police Service Act, 1995 (Act No. 68 of 1995), who has issued or served an infringement notice or recorded the particulars of an infringer or offender in terms of the Act, must submit the copy of such an infringement notice form AARTO 01 or form AARTO 32 on which the particulars of an offence have been recorded, together with such authorised officer's confirmation of service to the police station to which he or she is assigned.

 

(2)Upon receiving the copy referred to in subregulation (1)(a) or collecting the copy as contemplated in regulation 38(5(b) , the issuing authority must record the contents of the infringement notice form AARTO 01 or such document on which the particulars of an offence have been recorded form AARTO 32, in the National Road Traffic Offences Register in the manner contemplated in regulation 30.

 

(3)Issuing authorities, registering authorities and driving licence testing centres must retain records of all transactions executed by them in terms of the Act and these Regulations .

 

(4)The Authority  must keep record of all documents that are issued, served , received or deemed to have been received or served in terms of the Act and these Regulations.

 

(5)The Authority must, for the purposes of section 30(2) of the Act, keep all receipts issued by the postal service for the acceptance of documents that are served by postage.

 

(6)The Authority must keep records, for purposes of further reference, of all—
(a)applications , notifications and submissions furnished or received;
(b)payments received and payments in arrears;
(c)courtesy letters and enforcement  orders issued and served in terms of the Act; and
(d)revoked enforcement orders.

 

(7)Records of payments received, and receipts issued by an issuing authority, registering authority or driving licence testing centre must be kept in an electronic image until the time of disposal as contemplated in regulation 30.
