15. Record of proceedings and decisions of Tribunal

(1)An employee contemplated in section 29J of the Act must record and file appropriately, the hearings of the Tribunal.

 

(2)The Tribunal must notify the infringer, in accordance with regulation 35(4), of the decision made in relation to the appeal or review on form AARTO 10Ad.

 

(3)The Tribunal must inform the Authority, in accordance with regulation 35(5), of its decision made in terms of subregulation (2).

 

(4)Upon receipt of the decision of the Tribunal, the Authority must capture and process the details of the infringer on the National Road Traffic Offences Register in accordance with regulation 35(4) .

 

(5)If an application for an appeal or review is successful in that the infringement is set aside, the infringement notice must be cancelled depending on the order of the Tribunal.

 

(6)If an application for an appeal or review is unsuccessful and the infringer fails to pay the applicable infringement penalty and fees, if any, within  32 days after the date the infringer is deemed to have been notified as contemplated in subregulation (2), the registrar must issue, in accordance with regulation 35(4), an enforcement order as contemplated in regulation 5.

 

(7)Pending the decision of the Tribunal as contemplated in subregulation (2), no courtesy letter or enforcement order may be issued to the infringer and no demerit points may be allocated to the infringer.

 

*8)The clerk of the court must inform the Authority, in accordance with regulation 35(5), of an appeal or review against the decision of the Tribunal lodged with a Magistrate's Court in terms of section 29I of the Act within 10 days after such lodgement.

 

(9)Pending the decision of the Magistrate's Court, no courtesy letter or enforcement order may be issued to the infringer and no demerit points may be allocated to the infringer .

 

(10)The clerk of the court must inform the Authority in accordance with regulation 35(5) of the decision of the Magistrate's Court in relation to the review or an appeal of the decision of the Tribunal within seven days after such a decision has been made.

 

(11)If an application for an appeal or review to the Magistrate's Court is successful in that the infringement is set aside, the infringement notice must be cancelled depending on the order of the court.
