| (1) | An application for condonation contemplated in section 29B(3) of the Act may be made on form AARTO 34 submitted in accordance with regulation 35(1). |
| (2) | The Tribunal must inform the applicant, in accordance with regulation 35(4), of the outcome of the application made in accordance with subregulation (1) as contemplated in regulation 15(2). |
| (3) | If an application for condonation is successful, the infringer may make an application for an appeal or review in accordance with regulation 12 within a period of 14 days from the date of the outcome of the condonation application, provided that the notice in accordance with subregulation (2), is deemed to have been received by the infringer and the Tribunal must continue with the review or appeal as contemplated in section 29B (1) of the Act. |
| (4) | If an application for condonation is unsuccessful, the infringer must be issued with an enforcement order in accordance with regulation 5. |
