| (1) | A security service provider who— |
| (a) | contravenes or fails to comply with a provision of the Act; |
| (b) | commits an offence contemplated in the Schedule to the Act; |
| (c) | contravenes or fails to comply with a provision of the Levies Act; or |
| (d) | contravenes or fails to comply with a provision of this Code, |
is guilty of improper conduct and on conviction liable to any penalty contemplated in regulation 25.
| (2) | Any conspiracy, incitement or attempt to commit any act contemplated in subregulation (1)(a), (c) or (d) constitutes improper conduct as contemplated in subregulation (1). |
| (3) | The intentional provision of assistance by a security service provider to another security service provider to commit any act referred to in subregulation (1)(a), (c) or (d) constitutes improper conduct as contemplated in subregulation (1). |
| (4) | Every contravention or failure to comply as contemplated in subregulation (1), (2) or (3), constitutes a separate count of improper conduct in respect of which any penalty contemplated in regulation 25 may be imposed. |
