I, John Henry Steenhuisen, Minister for Agriculture, acting under sections 10, 13, 14, 15, 18 and 19 of the Marketing of Agricultural Products Act, 1996 (Act No 47 of 1996) hereby extend the following Notices, namely—
| (a) | Notice No. 1651 dated 31 December 2021 - regarding registrations in the dairy industry; |
| (b) | Notice No. 1652 dated 31 December 2021 - regarding records & returns in the dairy industry; and |
| (c) | Notice No. 1653 dated 31 December 2021 - regarding statutory levies in the dairy industry; |
Details of the extension can be found in the attached Schedule.

On 25 August 2025, the Minister of Agriculture received, in terms of section 10 of the Marketing of Agricultural Products Act, 1996 (Act No 47 of 1996) (MAP Act). a request from the South African Milk Processors' Organisation (SAMPRO), as sole applicant, for the continuation of statutory measures relating to levies, records & returns and registrations in the South African dairy industry.
On 26 November 2025, the Minister of Agriculture decided not to approve SAMPRO's application. The reasons for not approving SAMPRO's application was based on the fact that, (i) most of the directly affected groups in the dairy industry did not support the application by SAMPRO, and (ii) that it would not be in the interest of the South African dairy industry to support and implement the proposed dairy statutory measures.
After a number of meetings between different role players, where the Minister, the Chairperson of the NAMC, the Chairperson of the Milk Producers Organisation (MPO) and the Chairperson of the South African Milk Processors Organisation (SAMPRO), were involved, it was agreed in principle between the role players, to request the Minister to consider the extending the existing dairy statutory measures in order to allow time for the relevant stakeholders to find a long-term solution to their differences. Accordingly, the Minister undertakes as follows—
| a) | To extend regulation 1651, regulation 1652 and regulation 1653, [as previously published in Government Gazette No. 45703 dated 31 December 2021], for a period of six (6) months (from 1 January to 30 June 2026) and to further request the dairy industry to appoint an independent mediator to assist MPO and SAMPRO with the following within the six-month extension period: |
| • | To resolve their current impasse and to find a way of working cooperatively for the benefit and long-term viability of the dairy industry; and |
| • | To agree on a business plan in preparation for a joint application for new statutory measures in the dairy industry. The business plan should incorporate ways of resolving emerging challenges facing the industry such as biosecurity and the need to accelerate the transformation of the sector in line with NAMC's guidelines. |
