The Minister of Electricity and Energy ("the Minister"), in consultation with the National Energy Regulator of South Africa ("NERSA"), acting under Section 34(1)(b) of the Electricity Regulation Act, 2006 (Act No. 4 of 2006) (as amended) ("the ERA") and the Electricity Regulations on the New Generation Capacity published as GNR. 399 in Government Gazette No. 34262 dated 04 May 2011, as amended ("Regulations"), has determined as follows:
| 1. | The new generation capacity is needed to ensure the continued uninterrupted supply of electricity. |
| 2. | The 400 MW shall be generated from solar photovoltaic and natural gas according to the following quantum: |
| • | 100 MW - Solar PV |
| • | 300 MW - Natural Gas. |
| 3. | The buyer of the new generation capacity shall be eThekwini Metropolitan Municipality. |
| 4. | The generation capacity shall be procured by eThekwini Metropolitan Municipality through a tendering process which is fair, equitable, transparent, and competitive, and cost effective. |
