| (1) | In terms of regulation 4, the date of application for the registration of a management control system by the applicant shall be regarded as the date upon which the Executive Officer receives the application. |
| (2) | The application received by the Executive Officer for the registration of a management control system shall have priority over any subsequent application for registration of a management control system— |
| (a) | in respect of the same agricultural product; and |
| (b) | having the same or similar management control system. |
