| (1) | Notices and documents that are required by the Act to be served but not required to be served by registered mail as referred to in sections 17(3)(c), 18(8)(c), 19(3)(c), 20(1)(c) and 26(1), may be served by electronic service, where the electronic address of the infringer is available and confirmed by the infringer. |
| (2) | Notices and documents that are not required by the Act to be served, may be issued by electronic means, where the electronic address of the infringer is available and confirmed by the infringer. |
| (3) | If an infringement notice or an AARTO notice is to be served by electronic service or issued by electronic means, such an infringement notice or an AARTO notice must be addressed to the infringer's electronic address the details of which have been indicated by the infringer— |
| (a) | on either form AARTO 01 or AARTO 02, which he or she has confirmed as correct; |
| (b) | on the notice of change of address on form NCP as prescribed under the National Road Traffic Act; |
| (c) | as indicated in the register of driving licences or the register of motor vehicles; |
| (d) | in registering on the AARTO website; or |
| (e) | be addressed to any electronic address obtainable from a public body required to keep such information in terms of any law of the Republic, subject to the Protection of Personal Information Act, 2013 (Act No. 4 of 2013). |
